As per the provisions of the Local Government Act 1995 and its subsidiary legislation, Council must ensure certain Registers and Required Reports are kept and made available for public viewing.

Report on Elected Member Training and Professional Development

In September 2019 amendments to the Local Government Act 1995 (Act) and the Local Government (Administration) Regulations 1996 (Regulations) came into effect relating to training for elected members.

A mandatory training course, “Council Members Essentials” must be completed within 12 months of being elected. This course comprises the following five units:

  1. Understanding local government;
  2. Serving on council;
  3. Meeting procedures;
  4. Conflicts of interest; and
  5. Understanding financial reports and budgets

A person who is an elected member on the day on which the Regulations commenced was exempt from the requirement until the end of their term of office.

Pursuant to Section 5.127 of the Act a local government must prepare a report for each financial year on the training completed by elected members in the financial year. The CEO must publish this report on the local government's official website, within 1 month after the end of the financial year to which the report relates.

Record of Information about Conduct

A record of information is required to be published pursuant to the Local Government Act 1995 (the Act) relating to the following matters:

  1. behavioural breaches by a council member that are found under the local government’s code of conduct to have occurred
  2. recurrent breaches that are found under section 8A.14(4) of the Act to have been committed by a council member;
  3. conduct breaches by a council member that are found under section 8A.18 of the Act to have occurred;
  4. specified breaches that are found under section 8A.25 of the Act to have been committed by a council member;
  5. orders made under section 8A.14(5), 8A.18(4), 8A.21(2)(b), 8A.25 or 8A.27(2)(b) of the Act in respect of a council member;
  6. any other prescribed information about the conduct of a person who is, or of a person when they were, a council member, the CEO or another employee.

Regulation 29E of the Local Government (Administration) Regulations 1996 provides:

(1)    In this regulation oversight entity means any of the following —

(a)     the Inspector;

(b)     an Independent Inquiry;

(c)     the State Administrative Tribunal;

(d)     the Public Sector Commissioner;

(e)     the Corruption and Crime Commission;

(f)      a Royal Commission.

(2)     For the purposes of section 5.96C(1)(f), the following information is prescribed to the extent that it is about the conduct of a person who is, or of a person when they were, a council member, the CEO or another employee —

(a)     any adverse recommendation made by the Inspector in a report under section 8.4 that is provided to the local government;

(b)     any adverse finding, recommendation or proposition made by an oversight entity that is made available to the public.

The regulations further provide for purposes of section 5.96C(4)(c) and (d), information included in this record of information must be kept, and it must be published on the Shire of Ashburton’s website for the period of 12 years, beginning on the day on which the information is first included in the record of information.

The Shire’s Chief Executive Officer is authorised by Council to receive behavioural breach complaints.
